Who you are dealing with

Quantum Apothecary is an online store operated by Tonic Thought Studios, based in Minneapolis, MN 55406, United States. In these terms, "we" and "us" mean Tonic Thought Studios. "You" means the person using the site or placing an order.

Agreement

By browsing this store or placing an order, you accept these terms along with our Refund and Return Policy, Shipping Policy, and Privacy Policy, which are part of them. If you do not accept them, do not use the store.

You need to be old enough, where you live, to enter into a binding contract.

The products

Every item sold here is made to order and carries original artwork. Product images are digital mockups: the artwork is shown applied to a template of the garment or object, not photographed on the finished piece.

That means printed colour can differ slightly from what you see on screen. Ink behaves differently on different fabrics, dye lots vary, and no two monitors are calibrated the same. Minor variation in colour, print placement, and finish is normal and expected. Obvious print faults are not, and those are covered by the Refund and Return Policy.

Sizing charts are published on each product page. Read the chart for the item you are buying rather than assuming your usual size carries across.

Prices, availability, and errors

All prices are in US dollars and can change without notice. Shipping is calculated at checkout.

We try to keep every listing accurate, but descriptions, images, prices, and availability can contain errors. We reserve the right to correct errors, change or discontinue products, and refuse or cancel an order — including one already placed and paid for — where a listing was wrong, where a product is no longer producible, or where an order looks fraudulent. If we cancel an order you have paid for, you get a full refund. We do not owe you anything further.

Artwork and intellectual property

All artwork, designs, photographs, and text on this store and on the products sold here are original work and remain the property of Tonic Thought Studios. They are not stock art and they are not licensed to you.

Buying an item buys you the object. It does not transfer any right in the artwork printed on it. Wear it, use it, photograph it, resell the individual second-hand item if you want to. Do not reproduce the artwork, scan or photograph it for the purpose of copying it, print it on other goods, sell it as a design or file, or use it as training data for a machine learning system.

The Quantum Apothecary and Tonic Thought Studios names are ours as well.

Using the site

Do not attempt to interfere with the store, extract data from it in bulk, or use it to do anything unlawful. We can refuse service to anyone.

Returns

Returns, replacements, and refunds are governed by our Refund and Return Policy. In short: items are made to order, so change-of-mind and size-based returns are not accepted, while damaged, defective, and misprinted items are replaced or refunded if reported within 30 days of delivery.

Limitation of liability

We sell printed goods. We do not promise that the store will be uninterrupted or error free.

To the fullest extent the law allows, our total liability for any order is limited to the amount you paid for that order. We are not liable for indirect, incidental, or consequential losses — lost profits, lost time, missed occasions, or the cost of a substitute item — arising from a delayed, lost, or faulty order.

Some places do not allow these exclusions. Where that is the case, they do not apply to you, and nothing here limits rights you have under the consumer law of your own country.

Governing law

These terms are governed by the laws of the State of Minnesota, United States, without regard to conflict-of-law rules. Disputes go to the state or federal courts located in Hennepin County, Minnesota. If you are a consumer outside the United States, this does not deprive you of the protection of mandatory consumer law in your own country.

Changes to these terms

We can revise these terms at any time. The current version always lives on this page, with the date it was last updated at the top. Changes apply to orders placed after they are posted. Continuing to use the store after a change means you accept the revised terms, so it is worth a glance at the date before you order.
